COUNCIL BRIEFS

PENALTIES in a number of Council local laws are by the way of "on the spot fines". On occasions, when Council enforces a local law, residents receiving an "on the spot" fine are angered by the fact that they were unaware of the particular local law.

The latest to cause concern is Local Law No 8 Part 4 - Miscellaneous in relation to Vehicles For Sale On Land Under The Control Of Council.

This has caused Council to review its policy regarding vehicles for sale on land under the control of council, and those who have made applications to Council for "on the spot fines" to be waived will be assessed under the new guidelines

I urge those residents who have, or may be contemplating, selling a vehicle from the roadside to familiarise themselves with the policy to prevent the risk of receiving an "on the spot" fine.

I notice that there are a number of vehicles appearing on the roadside in this area with "for sale" signs in contravention of the council policy. The new policy is:

VEHICLES FOR SALE ON LAND UNDER THE CONTROL OF COUNCIL:

Vehicles on the Road or Road Verge
Vehicles that are parked on a made road or road verge and are for sale will be issued with a warning and if the warning is not heeded, an "on the spot" fine will be issued.
 
Vehicles on the Footpath at Owners Premises
In the case of a vehicle parked on the footpath outside of the owners premises, whether for sale or not, on the first offence a warning will be given and if the warning is not heeded an on the spot fine will be issued.

VEHICLES ON LAND UNDER THE CONTROL OF COUNCIL NOT AT OWNER’S PREMISES:

If a vehicle is parked on land under the control of council other than at the front of the premises and is for sale, a fine may be issued without warning or notice (An example of locations affected by this provision - popular car sales spots - David Low Way, Fishermen’s Road Corner, Main Road ,Maroochydore, Willis Road, Bli Bli, Pacific Paradise, Emu Road, Fourth Avenue Cotton Tree etc )

VEHICLES ON LAND UNDER THE CONTROL OF COUNCIL GENERALLY:

Where vehicles are parked on land under the control of Council (footpath, parks etc) and the vehicle is obstructing pedestrian movement, or is a traffic hazard, or is causing damage to the land on which it is parked, a fine may be issued without notice or warning at the discretion the Enforcement Officer. The extent of obstruction to movement, the degree of traffic hazard or the amount of damage being caused to the land will be taken into account.

IT IS very pleasing to see the Kiel Mountain Interchange is back on track. Service relocations are to commence in October and contract awarded December/January for completion July/August 1999 (weather permitting).

I thank the Member for Nicklin, Peter Wellington, MLA for his support for bringing the project back on line. Although the overpass is not his preferred option, he puts his full weight behind it and is anxious that it be completed on time

COUNCIL'S draft strategy for waste management called "Today's Waste Tomorrow's Resource" is now available for public comment. It is not about where the next landfill will be located, but is to do with how we reduce waste sent to landfill. Unfortunately, the public consultative meeting scheduled for Palmwoods has been and gone but interested residents can attend the meeting at the Civic Centre, Nambour on Wednesday September 30, at 7.30 pm. Written submissions should be with Council no later than October 16, 1998. Inquiries to Chris Greaves phone 5441 8653.

The aim of the strategy and associated action plan is to reduce the amount of waste per capita sent to landfill by 50% by the year 2000 (based on 1990 levels). Currently Maroochy Shire has a population of 112,000, with a growth of 6%; generating annual waste of 102,000 tonnes; annual waste budget is $8.3million; current reduction in waste to landfill via recycling is 36%. There are 41,000 domestic and 5000 commercial waste services. Landfills are at Coolum, Nambour and Buderim with transfer stations at Yandina, Kenilworth and Mapleton.

THE waste collection area has now been extended to include residences at Lower Landershute.
